Terms of Service

These terms govern your use of the OneMind Solutions website and the services we provide. Where a signed project agreement or Statement of Work exists, that document takes precedence over anything below.

1. Acceptance of Terms

By accessing or using the services of OneMind Solutions Private Limited (“Company”, “we”, “us”), you agree to be bound by these Terms of Service. If you do not agree with them, please do not use our services.

2. Services

OneMind Solutions provides web development, mobile application development, API development and integration, payment gateway integration, e-commerce solutions, digital marketing and related IT services. All engagements are subject to a separate written agreement or Statement of Work (SoW), which prevails over these general terms where the two differ.

3. Client Responsibilities

You agree to:

• provide accurate and complete project requirements;
• make timely payments in accordance with the agreed schedule;
• review and approve deliverables within the agreed review period;
• not use our services for any illegal, fraudulent or harmful purpose.

4. Intellectual Property

Upon receipt of full payment, all custom deliverables created exclusively for you become your property, including source code. OneMind Solutions retains rights to the generic tools, libraries, frameworks and methodologies used during development. We also retain the right to display completed work in our portfolio unless otherwise agreed in writing.

5. Payment Terms

Payment terms are specified in each individual project agreement. As a general rule: 50% advance is required before a project commences, and the remaining 50% falls due before final delivery. Delayed payment may result in work being placed on hold. Unless stated otherwise, prices are exclusive of applicable GST.

6. Third-Party Services

Projects frequently depend on third-party services such as payment gateways, hosting providers, courier APIs and advertising platforms. Their availability, pricing and policies are outside our control. We are not liable for downtime, price changes or policy changes imposed by these providers, though we will assist in resolving issues arising from them.

7. Limitation of Liability

OneMind Solutions shall not be liable for any indirect, incidental or consequential damages arising from the use of our services. Our maximum aggregate liability shall not exceed the total amount paid by you for the specific service giving rise to the claim.

8. Governing Law

These terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts of Udaipur, Rajasthan. For queries, write to contact@onemindsolution.in.
